Renting an apartment or house is always about relationships. And besides a good rental agreement, it should be based on mutual trust between you (as the landlord) and your tenant. You don't want to lose money or have your property damaged, and the tenant expects quality housing that corresponds to the agreed price.
Today you can find plenty of rental agreement templates on the internet. But before you download and sign one, stop and think. A rental agreement is not just a formal document. It's your guide and protector that clearly defines the responsibilities, rights, and obligations of both parties. It's a tool that ensures a smooth rental relationship and minimizes any misunderstandings in the future.
Therefore, devote sufficient time to preparing the rental agreement. It's an investment that will pay off many times over. And don't forget the important rule: what you don't explicitly prohibit in the agreement is considered permitted (such as smoking or pets).
What should a rental agreement contain?
To ensure both parties feel secure, none of these important elements should be missing:
- Identification of contracting parties: Clear information about you and the tenant (we also recommend identity verification for your peace of mind).
- Precise designation and description of the rental subject: From the apartment, through accessories, to its current condition.
- Scope of use: What the tenant can use within the property and its surroundings.
- Rights and obligations: Clear definition for both parties.
- Division of responsibility: Who takes care of basic maintenance and minor repairs.
- Rental period: How long the rental lasts.
- Rent amount and payments: Precisely defined payments for rent, utilities, TV, internet, etc.
- Increase mechanism: How rent and payments will increase (e.g., due to inflation).
- Payment terms and method: When and how the tenant should pay.
- Settlement of overpayments/underpayments: How potential differences between advances and actual costs are settled.
- Notice period and conditions: Clear rules for terminating the rental from both sides.
- Contract termination conditions: When it's possible to terminate the contract.
- Settlement of security deposit: How and when the deposit is returned, or what it's used for.
- Handover protocol: Detailed description of the apartment's condition, damages, and utility meter readings during handover (absolutely essential!).
- Confirmation of understanding and signatures: Confirms that both parties understand the contract content and agree to it.
- Date and signatures of contracting parties.
Think about details that will protect your property
Don't forget to add specific conditions to the agreement that will prevent potential problems:
- Property insurance: The property can be insured, including its accessories. You need to define what you're responsible for as the landlord and what the tenant can insure.
- Tenant obligations: For example, observing quiet hours, informing about mail or notices in the building.
- Prohibitions: Whether smoking, keeping pets, subletting the property, moving furniture, or making structural modifications (like drilling and gluing to walls) is permitted.
- Fire responsibility: Clear definition of who is responsible for what.
- Entry conditions: When and under what conditions you as the landlord can enter the apartment.
- Any other rental conditions that are important to you.
