Acceptance protocol

Necessary document when renting a property

The handover protocol is an integral part of every rental agreement. It serves as evidence of the property's condition at the time it was handed over to the tenant and protects the rights of both parties. Its preparation is necessary for the smooth running of the lease and can prevent later disputes about possible damages or deficiencies.

Why is the acceptance protocol important?

  • Landlord Protection: Ensures that the tenant takes possession of the property in a specified condition and is responsible for any damage they cause.
  • Tenant protection: Documents existing defects and damages, thereby protecting the tenant from unauthorized claims for damages at the end of the lease.
  • Proof of Agreement: Evidence that both parties agree to the condition of the property at the time of handover.

What should the acceptance protocol contain?

  • Introductory information:

    • Data on contractual parties (lessor, lessee)
    • Exact address of the property
    • Date and time of handing over the property
  • Description of the property:

    • Total area of the property
    • Number of rooms and their layout
    • Materials of used surfaces (floors, walls, doors)
    • Equipment (kitchen, bathroom, other)
  • Condition of the property:

    • Detailed description of the condition of individual rooms, including:
    • Surface treatments (paint, wallpaper, tiling)
    • Windows, doors, locks
    • Electrical installations, lighting
    • Plumbing, sanitation
    • Heating, ventilation
    • Other equipment (stove, refrigerator, washing machine, etc.)
  • A list of all detected damages and deficiencies with a precise description of their location and extent

  • Consumption measurement:

    • Status of all energy meters (electricity, gas, water)
  • Keys:

    • List of transferred keys (number, type)
  • Final Provisions:

    • Declaration by both parties that they agree with the condition of the property
    • Date and signatures of the contracting parties

Important notices

  • Photo documentation: Each point in the protocol should be supported by a photo that clearly documents the condition of the property.
  • Accuracy: All information in the log must be accurate and complete. Even minor flaws need to be noted.
  • Objectivity: Describe the condition of the property objectively, without unnecessarily emphasizing positive or negative aspects.
  • Mutual agreement: Both parties should have the opportunity to review and comment on the content of the protocol before signing it.

Why is photo documentation important?

The photos serve as visual evidence of the condition of the property at the time of handover. In the event of a dispute, they can be used as evidence that the tenant took over the property in a specific condition and that any damage occurred only during the lease.

Conclusion

A carefully prepared takeover protocol is an essential tool for protecting the rights and interests of both parties to the tenancy relationship. If you pay enough attention to its preparation, you can prevent many problems and ensure a peaceful living.
