Tento z\u00e1kon bol vytvoren\u00fd s cie\u013eom chr\u00e1ni\u0165 n\u00e1jomcu ako slab\u0161iu stranu, \u010do sa premieta do <strong>nevyv\u00e1\u017een\u00e9ho vz\u0165ahu<\/strong> v prospech n\u00e1jomcu. Zauj\u00edmavos\u0165ou je, \u017ee zmluva pod\u013ea Ob\u010dianskeho z\u00e1konn\u00edka <strong>nemus\u00ed by\u0165 ani v p\u00edsomnej podobe,<\/strong> sta\u010d\u00ed z\u00e1pisnica o \u00fastnej dohode. Aj napriek tomu Ti <strong>d\u00f4razne odpor\u00fa\u010dame zmluvu v\u017edy uzatv\u00e1ra\u0165 p\u00edsomne<\/strong>, ide\u00e1lne s not\u00e1rsky overen\u00fdmi podpismi, \u010do zvy\u0161uje pr\u00e1vnu istotu.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"akszkladnrtyzmluvypodatohtozkona\">Ak\u00e9 s\u00fa z\u00e1kladn\u00e9 \u010drty zmluvy pod\u013ea tohto z\u00e1kona?<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>V\u00fdpovedn\u00e1 doba:<\/strong> Minim\u00e1lne <strong>3 mesiace<\/strong>, ktor\u00e1 sa predl\u017euje o <strong>\u010fal\u0161\u00edch 6 mesiacov<\/strong>, ak je n\u00e1jomca v hmotnej n\u00fadzi.<\/li>\n\n\n\n<li><strong>Trvanie n\u00e1jmu:<\/strong> Mo\u017en\u00e9 na <strong>ak\u00e9ko\u013evek obdobie<\/strong>, vr\u00e1tane doby neur\u010ditej.<\/li>\n\n\n\n<li><strong>Ukon\u010denie n\u00e1jmu bytu:<\/strong> Zmluva na dobu ur\u010dit\u00fa sa automaticky skon\u010d\u00ed uplynut\u00edm tejto doby.<\/li>\n\n\n\n<li><strong>Pred\u013a\u017eenie n\u00e1jmu inej nehnute\u013enosti:<\/strong> Ak n\u00e1jomca u\u017e\u00edva in\u00fa nehnute\u013enos\u0165 (napr. dom, gar\u00e1\u017e, chata, nebytov\u00fd priestor) aj po skon\u010den\u00ed n\u00e1jmu a Ty ako prenaj\u00edmate\u013e nepod\u00e1\u0161 n\u00e1vrh na vypratanie, zmluva sa automaticky predl\u017euje za rovnak\u00fdch podmienok, maxim\u00e1lne v\u0161ak o <strong>1 rok<\/strong>.<\/li>\n\n\n\n<li><strong>Prehliadky po\u010das v\u00fdpovednej doby:<\/strong> N\u00e1jomca je povinn\u00fd strpie\u0165 prehliadky za \u00fa\u010delom \u010fal\u0161ieho pren\u00e1jmu, pokia\u013e sa nedohodnete inak.<\/li>\n\n\n\n<li><strong>Podn\u00e1jom:<\/strong> N\u00e1jomca m\u00e1 pr\u00e1vo da\u0165 prenajat\u00fa vec do podn\u00e1jmu, ak zmluva neur\u010duje inak.<\/li>\n\n\n\n<li><strong>Zodpovednos\u0165 za \u0161kodu:<\/strong> N\u00e1jomca je povinn\u00fd stara\u0165 sa o to, aby na veci pren\u00e1jmu nevznikla \u0161koda, inak za \u0148u zodpoved\u00e1.<\/li>\n\n\n\n<li><strong>Stav pri vr\u00e1ten\u00ed:<\/strong> N\u00e1jomca je povinn\u00fd vr\u00e1ti\u0165 prenajat\u00fa vec v stave, v akom ju prevzal, s prihliadnut\u00edm na obvykl\u00e9 opotrebovanie.<\/li>\n\n\n\n<li><strong>Oznamovanie opr\u00e1v:<\/strong> N\u00e1jomca je povinn\u00fd ozn\u00e1mi\u0165 prenaj\u00edmate\u013eovi potrebu opr\u00e1v, ktor\u00e9 m\u00e1 vykona\u0165 prenaj\u00edmate\u013e, inak zodpoved\u00e1 za sp\u00f4soben\u00fa \u0161kodu.<\/li>\n\n\n\n<li><strong>N\u00e1klady na u\u017e\u00edvanie a drobn\u00e9 opravy:<\/strong> Tieto n\u00e1klady hrad\u00ed n\u00e1jomca, pokia\u013e nebolo dohodnut\u00e9 inak.<\/li>\n\n\n\n<li><strong>N\u00e1rok na z\u013eavu\/oslobodenie od n\u00e1jomn\u00e9ho:<\/strong> N\u00e1jomca nie je povinn\u00fd plati\u0165 n\u00e1jomn\u00e9, ak pre n\u00edm nesp\u00f4soben\u00e9 \u0161kody nemohol prenajat\u00fa vec u\u017e\u00edva\u0165 dohodnut\u00fdm sp\u00f4sobom, pr\u00edpadne m\u00e1 n\u00e1rok na primeran\u00fa z\u013eavu.<\/li>\n\n\n\n<li><strong>Mo\u017enos\u0165 odst\u00fapenia od zmluvy:<\/strong> N\u00e1jomca je opr\u00e1vnen\u00fd odst\u00fapi\u0165 od zmluvy, ak sa predmet n\u00e1jmu stal nesp\u00f4sobil\u00fd na obvykl\u00e9 u\u017e\u00edvanie alebo je pobyt v \u0148om zdraviu \u0161kodliv\u00fd.<\/li>\n\n\n\n<li><strong>Obmedzenia pre majite\u013ea a d\u00f4vody v\u00fdpovede:<\/strong> Majite\u013e nehnute\u013enosti m\u00f4\u017ee vypoveda\u0165 zmluvu len v z\u00e1konom obmedzenom rozsahu (napr. potreba bytu pre seba\/bl\u00edzku osobu, hrub\u00e9 poru\u0161ovanie povinnost\u00ed n\u00e1jomcom, neplatenie n\u00e1jomn\u00e9ho). V niektor\u00fdch pr\u00edpadoch m\u00f4\u017ee ma\u0165 n\u00e1jomca n\u00e1rok na bytov\u00fa n\u00e1hradu a \u00fahradu n\u00e1kladov spojen\u00fdch so s\u0165ahovan\u00edm.<\/li>\n\n\n\n<li><strong>Spory a v\u00fdpove\u010f:<\/strong> Podanie \u017ealoby zo strany n\u00e1jomcu pre neplatnos\u0165 v\u00fdpovede <strong>odklad\u00e1 pr\u00e1vne \u00fa\u010dinky skon\u010denia n\u00e1jmu<\/strong> \u2013 v\u00fdpove\u010f nadobudne platnos\u0165 a\u017e po pr\u00e1voplatnosti rozhodnutia s\u00fadu.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"ovetkomuszmluvapodaobianskehozkonnkaobsahova\">\u010co v\u0161etko mus\u00ed zmluva pod\u013ea Ob\u010dianskeho z\u00e1konn\u00edka obsahova\u0165?<\/h3>\n\n\n\n<p>Aby bola zmluva platn\u00e1, mus\u00ed \u0161pecifikova\u0165:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Ozna\u010denie predmetu n\u00e1jmu<\/strong> a rozsah jeho u\u017e\u00edvania.<\/li>\n\n\n\n<li><strong>V\u00fd\u0161ku n\u00e1jomn\u00e9ho<\/strong> a \u00fahrad za plnenia spojen\u00e9 s u\u017e\u00edvan\u00edm bytu.<\/li>\n\n\n\n<li><strong>Opis pr\u00edslu\u0161enstva<\/strong> a aktu\u00e1lneho stavu bytu.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"oobianskyzkonnknepopisujeakotoriei\">\u010co Ob\u010diansky z\u00e1konn\u00edk nepopisuje? Ako to rie\u0161i\u0165?<\/h3>\n\n\n\n<p>Z\u00e1kon ne\u0161pecifikuje, ako rie\u0161i\u0165 niektor\u00e9 k\u013e\u00fa\u010dov\u00e9 aspekty, ktor\u00e9 s\u00fa pre prenaj\u00edmate\u013ea d\u00f4le\u017eit\u00e9. Ak ich chce\u0161 ma\u0165 o\u0161etren\u00e9, mus\u00ed\u0161 ich jasne definova\u0165 priamo v zmluve:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Jednostrann\u00e1 zmena v\u00fd\u0161ky n\u00e1jomn\u00e9ho (napr\u00edklad v reakcii na infl\u00e1ciu):<\/strong>\n<ul class=\"wp-block-list\">\n<li><em>Rie\u0161enie:<\/em> Dohodnite si v zmluve mechanizmus zvy\u0161ovania n\u00e1jomn\u00e9ho, napr\u00edklad viazan\u00fd na infl\u00e1ciu alebo index spotrebite\u013esk\u00fdch cien zverej\u0148ovan\u00fd \u0160tatistick\u00fdm \u00faradom SR. Bez takejto dolo\u017eky m\u00f4\u017ee by\u0165 zmena n\u00e1jomn\u00e9ho n\u00e1ro\u010dn\u00e1.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Sp\u00f4sob v\u00fdpo\u010dtu n\u00e1jomn\u00e9ho a \u00fahrad za slu\u017eby spojen\u00e9 s u\u017e\u00edvan\u00edm bytu:<\/strong>\n<ul class=\"wp-block-list\">\n<li><em>Rie\u0161enie:<\/em> Jasne \u0161pecifikuj nielen v\u00fd\u0161ku n\u00e1jomn\u00e9ho, ale aj rozpis preddavkov na energie (voda, plyn, elektrina, k\u00farenie) a ostatn\u00e9 slu\u017eby (smeti, spolo\u010dn\u00e9 priestory). Stanovte lehoty a sp\u00f4sob vy\u00fa\u010dtovania t\u00fdchto z\u00e1lohov\u00fdch platieb.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Finan\u010dn\u00e1 z\u00e1bezpeka (kaucia):<\/strong>\n<ul class=\"wp-block-list\">\n<li><em>Rie\u0161enie:<\/em> Hoci Ob\u010diansky z\u00e1konn\u00edk priamo nedefinuje kauciu, v zmluve si ju m\u00f4\u017ee\u0161 dohodn\u00fa\u0165 ako &#8222;pe\u0148a\u017en\u00fa z\u00e1bezpeku&#8220; na pokrytie nedoplatkov, \u0161k\u00f4d alebo nedoplatkov n\u00e1jomn\u00e9ho.
